The real cost of getting it wrong

Why foreigners lose money in Asia

Every month we review deals where the damage was already done: nominee deeds, unverified titles, contracts written by the seller’s friend. Here is the exact difference between the trap and the protocol.

The Unregulated “Fixer” / Local Agent Trap

  • Illegal nominee land deeds. Your “helper” puts the land in a Filipino/Indonesian friend’s name. Those structures are void under the Constitution and Anti-Dummy Law — and the nominee can walk away with your money.
  • 300% hidden expat markups. Processing fees, “connections”, translations and filing costs quietly multiplied because nobody quotes you a fixed scope in writing.
  • Unverified land titles. Tax declarations presented as “titles”, fake Transfer Certificates of Title, double-sold lots — never checked at the Registry of Deeds or BPN.
  • Zero legal recourse. No engagement letter, no receipt, no attorney of record. When it goes wrong, you have nobody to sue and no bar association to complain to.

The AbroadLawyers.com Protocol

  • Direct engagement with licensed Bar attorneys. IBP, PERADI and Lawyers Council roll numbers verified before you ever speak. Retainer signed with the law firm, not with us.
  • Pre-negotiated fixed fees in English. The scope, deliverables and turnaround are agreed in writing before you pay a cent. Milestone billing through client accounts.
  • Conflict-of-interest checks. Your counsel certifies independence from the seller, the developer and the real estate agent — the most common conflict in Asian property deals.
  • Full recourse. Bar-registered attorneys answer to their bar association and their professional indemnity. Every engagement leaves a paper trail you can enforce.

Jurisdiction intelligence

Six jurisdictions. Six completely different rulebooks.

What works in Manila is illegal in Bali. What protects you in Bangkok does nothing in Ho Chi Minh City. Select a jurisdiction to see the local reality our counsel navigates daily.

Philippines 🇵🇭 — ownership is capped, not forbidden

Foreigners cannot own land, but can own condominium units up to the 40% foreign-ownership cap of any building — and can secure long-term control of houses on leased land through 25-year renewable private land leaseholds (up to 50 years). Marriage to a Filipino does not create ownership rights for you, but it creates serious asset-protection questions for your spouse that must be settled before the wedding.

Condo acquisition: title due diligence at the Registry of Deeds + 40% cap verification.
SEC foreign corporation: 60/40 domestic rules, foreign investment negative list.
Prenuptial agreements: must be executed before the marriage to be valid.
Foreign divorce recognition: a court petition (Rule 108) is required for PSA records.
SRRV retirement visa: deposit-based residency via PRA.
Leaseholds 25+25: the standard structure for houses and businesses on land.

Quick triage

For boutique law firms · Founding Partner intake open

For Licensed Boutique Law Firms in Southeast Asia: Receive Pre-Qualified Foreign Clients. Zero Upfront Marketing Cost.

We are onboarding Founding Legal Partners in Manila, Cebu, Iloilo, Bali, Jakarta, Bangkok, Ho Chi Minh City, Kuala Lumpur and Phnom Penh. You keep practicing law; we keep the client pipeline full.

1 · No “Free Advice” Time-Wasters

Every foreign client sees the standardized scope and commits to a written fixed-fee brief before your firm is ever contacted. We filter out tire-kickers, budget-less inquiries and “quick question” spam before a single minute of your team’s time is spent.

2 · Pre-Qualified, Budget-Stamped Briefs

Each case brief arrives structured: jurisdiction, practice area, urgency and a declared transaction-value tier. Your intake team qualifies an engagement in minutes — and you quote a fixed fee from day one, in English, with the scope already framed.

3 · You Practice Law. We Run the Funnel.

SEO, expat communities, paid content and referral partnerships are our cost, not yours. Zero upfront cost in Phase 1 — our platform fee applies only to engagements you accept, and the terms are disclosed in writing at accreditation.

Founding Partner terms

You Set Your Own Fixed-Fee Quotes.

We never dictate your firm’s legal fees. We structure the client’s chaotic questions into a clean, standardized legal scope with verified deal context, and your firm submits its own flat-fee or milestone proposal directly to the client.

Roster capped at 3 boutique firms per city and practice area — first accredited keeps slot priority as we scale. No exclusivity required, no minimum volume, leave at any time. Founding Partners also help shape the network’s vetting standards.

Accreditation requires: active bar registration (IBP / PERADI / Lawyers Council / national equivalent) · English interview · conflict-of-interest declaration · one paid pilot scope. We verify before we list — our clients (and your future ones) rely on it.

Straight answers

Legal questions expats actually ask

Can a foreigner legally own land in the Philippines or Bali?

In the Philippines, no — the 1987 Constitution reserves land for Filipino citizens. You can own a condominium unit (up to the 40% foreign quota of the building) and hold a house on a registered 25-year renewable lease. In Bali and the rest of Indonesia, freehold (Hak Milik) is also citizen-only; your legal options are Hak Pakai, registered leasehold (Hak Sewa), or ownership through a PT PMA company. Any “your name on a nominee’s title” arrangement is void under the law and will not protect you in court.

Why shouldn’t I just use my real estate agent’s lawyer?

Because the agent’s lawyer works for the person paying the commission. We routinely see “closings” where the counsel never checked the title, skipped encumbrance searches, or drafted contracts that only protect the seller. Under our protocol, your attorney certifies in writing that they have no commercial relationship with the seller, developer or broker — and their fee comes from you alone.

How does AbroadLawyers.com verify attorneys?

Four gates, all documented: (1) active roll-number verification with the IBP, PERADI, the Lawyers Council of Thailand, or the equivalent national bar; (2) a video interview in English assessing legal communication, not just conversation; (3) a conflict-of-interest declaration covering real estate agencies and developers; (4) a paid pilot scope with a test client before full listing. Firms are re-reviewed every 12 months and removed after verified client complaints.

Is it legal to use a local nominee for a company or land?

No — and this is the single most expensive mistake we see. In the Philippines, nominee arrangements to circumvent foreign-ownership limits can violate the Anti-Dummy Law (a criminal statute). In Indonesia, courts treat nominee deeds as void, leaving the “real owner” with no enforceable rights. In Thailand, the Foreign Business Act carries fines and imprisonment for both the foreigner and the Thai nominee. There are always legal alternatives — leaseholds, Hak Pakai, PT PMA, BOI structures — and our counsel will tell you honestly which one fits your case.

How much does it actually cost — and when do I pay?

The case brief and the two proposals are free. Each proposal is a fixed-fee quote in writing: a single number covering defined deliverables, not open-ended hourly billing. You receive up to two independent quotes, so you can compare local market rates before engaging — and you pay the law firm directly, never us.

Do the lawyers really speak English — and do you handle my time zone?

Every listed firm passes a video interview conducted in English and commits to written communication in English, with documents delivered bilingually where local filing requires the national language. Counsel across our network covers CET-morning through UTC+8 business hours, and each matched attorney states their average response time on your dossier card — our current network average is under 4 business hours.
